TERMS OF USE

1. Scope of Use
The material provided by ShrinkYourself.com (Shrink Yourself) is for educational and informational purposes only—Shrink Yourself is not a healthcare practitioner. The material is not intended as a substitute for medical and/or health advice and the material should not be relied upon for dieting or for seeking medical and health recommendations. Members are responsible for their own health (physical and mental), diet research and decisions; therefore please consult with your physician or healthcare practitioner before dieting or making any personal health decisions.

2. Eligible Users
Shrink Yourself is available only to individuals eighteen years of age and older, and to individuals who can form legally binding contracts under applicable law. By using Shrink Yourself, you represent and warrant that you meet these criteria and you agree to having the ability under applicable law to enter into a legally binding contract. This is a legally binding contract.

3. Individual Use
You are only authorized to use this site for your own individual use, and may not duplicate, download, publish, modify or otherwise distribute any material on Shrink Yourself for any purpose other than for your own individual use, unless otherwise specifically authorized by Shrink Yourself. You agree not to transfer or resell your use of or access to your program to any third party.

4. Payment & Refunds
When you select the "Pay as you go" option, your credit card will be charged $40 for the first month of the program, and then $40 on the 28th day from the signup date for the second month of the program, and $40 on the 56th day from the signup date for the third month of the program. You are purchasing time to use the program ($40 per 30 days), not access to individual sessions. If and only if, you complete all 12 Guided Sessions and you can truthfully tell us you did not benefit from the program you will be eligible for a $120 refund. Further, you will only be eligible for a refund if you contact us within the 14 days following the date you completed your final Guided Session.

5. Membership Duration
Your membership is for 12 weeks (90 days), starting on the signup date and ending on the 90th day after signup. You have 90 days to complete the 12-week program. After that you may extend your membership for 30 days for $9.95.

When your membersip expires and before you have completed the 12 Guided Sessions, you will be given the opportunity to extend your membership for free for two weeks. You can get two 2-week free membership extensions in order to compete the 12 Guided Sessions. After the two free 2-week extensions are used, you can renew your membership for 30-days for $9.95.

The Hunger Coach program will become available after you complete the Guided Session for week four and until your membership expires. After that, you can renew your membership for 30 days for $9.95. The free membership extensions do not apply to use of the Hunger Coach. After your first renewal, each 30 days your credit card will be charged $9.95 until you cancel your next 30 day's renewal. Renewal fees are not refundable.

6. Cancellation
You can cancel your membership anytime. To cancel your membership, please use Contact Us. Canceling prohibits logging into your membership and to access unused sessions or data: Your membership is for time to use the program, not access to individual sessions. Canceling your membership does not include a refund. However, if you pay for and complete the entire 12 week program, we will refund the $120 membership fee if you can truthfully tell us you did not benefit from the program. Further, you will only be eligible for a refund if you contact us within the 14 days following the date you completed your final Guided Session. The $9.95 monthly membership renewals are not refundable.

7. General Terms and Conditions
You agree to:

• Maintain the security of your login name, password and other confidential information relating to your Shrink Yourself account;
  
• Be responsible for the status of your account, including the cancellation of your account before your next billing period, if applicable;
  
• Be responsible for all charges made by you to Shrink Yourself for the use of your account, including unauthorized use prior to your notifying Shrink Yourself of such use, and taking steps to prevent its further occurrence by changing your password. Any disputed charges must be made within 60 days contacting us;
  
• Update your personal information, including email address and current credit card information. Members must provide a valid email address.

8. Warranty Disclaimer
Access to and use of the services is at your own risk. The services are provided on an 'as is' and 'as available' basis. Shrink Yourself does not warrant that the site or any of its services will be uninterrupted or error-free, including temporary site unavailability or short term server crashes. If you experience ongoing technical problems, please contact us.

9. Waiver, release and limitation of liability
You agree that neither Shrink Yourself, nor its affiliates, subsidiaries, officers, directors, employees, agents, consultants or information providers or suppliers, shall have any liability to you under any theory of liability or indemnity in connection with your use of Shrink Yourself. You hereby release and forever waive any and all claims you may have against Shrink Yourself, its officers, directors, employees, agents, consultants, information providers or suppliers for losses or damages you sustain in connection with your use of Shrink Yourself. The total liability of Shrink Yourself and its officers, directors, employees, agents, consultants, information providers and suppliers, if any, for losses or damages shall not exceed the fees paid by you for the particular information or service provided. All other damages, direct or indirect, special, incidental, consequential or punitive arising from any use of the information or other parts of Shrink Yourself are hereby excluded even if Shrink Yourself or its officers, directors, employees, agents, consultants, information providers or suppliers have been advised of the possibility of such damages. Void where prohibited by law.

• Shrink Yourself will set and access a cookie on your computer when you select "Remember me..." on the login page.

• Shrink Yourself employs strict security measures to safeguard online data. Personal identification information is stored in a secured database. Credit card information is always sent via an encrypted channel. Clinical data is stored in a secured database. Our procedural safeguards comply with federal regulations to protect personal information about you.
  
• ShrinkYourself.com uses industry-standard SSL-encryption to protect credit card data transmissions.

5. Changes to this Privacy Policy
